The Charter of State Unification and Establishment of the Government of Shamrock State


Preamble

In the interest of establishing a stronger, more united, and more effective government for the citizens residing throughout our lands, with Congressional approval from Washington D.C. and the sitting President, the governments of the former states hereby recognize the necessity of unification under a Statehood, and entrance into the Union as the 46th State of the United States of America.

By this charter, the territories formerly governed as separate states shall be joined together under one common government, known henceforth as the State of Shamrock.

This unification preserves the voices and traditions of our individual communities while creating a centralized government capable of maintaining law, order, health, prosperity, and justice for all citizens.


Article I — The Counties and Territories of Shamrock State

The former states of Lemoyne, New Hanover, and West Elizabeth shall henceforth be recognized as counties of Shamrock State:

  • Lemoyne County
  • New Hanover County
  • West Elizabeth County

The City of Saint Denis shall be recognized as the capital and principal seat of government of the State of Shamrock. The offices of the Governor, the Courts of Shamrock, and such other departments and institutions as established by law shall be seated therein. The Assembly of County Representatives shall convene within the City of Blackwater as the official seat of the Legislative Branch.

Other regions presently under the authority of Shamrock State may remain organized as territories until such time that population and settlement justify their recognition as counties by act of the Legislature.

Each county shall maintain representation within the government of Shamrock State.


Article II — The Executive Branch

The Executive Branch shall be headed by the Governor of Shamrock State, who shall serve as the chief steward of the State and the executor of its laws.

Section I — Governor

The Governor shall possess the authority to:

  • Administer and enforce the laws of Shamrock State.
  • Issue Executive Orders concerning the administration and operation of the State.
  • Approve or veto legislation passed by the Legislature.
  • Appoint officers and officials as permitted under State law.
  • Affirm the appointments of duly elected Sheriff(s) and their appointed Deputies
  • May appoint and remove Marshals to the Marshal Service
  • Represent the interests and welfare of all citizens.

Section II — Deputy Governor

The Office of the Deputy Governor is to be established for the following purpose:

  • To assume the powers and responsibilities of the Governor should the duly elected Governor become incapable of discharging the duties of the office, and to continue in such office for the remainder of the term.
  • To sit as the Governor's representative before the State House of Representatives, and to cast no vote therein except to determine an equal division among its members.

Section III — Attorney General

The Attorney General shall serve as the principal legal officer of the State.

The Attorney General shall:

  • Prosecute crimes on behalf of Shamrock State.
  • Advise government officials on matters of law.
  • Act within statutes passed by Congress and the Constitution.

The Attorney General shall not possess the authority to enact or create laws, impose criminal judgment or punishment absent due process of law, nor overturn, disregard, or supersede the lawful decisions of the Courts.

  • Bring legal challenges before the Court when laws or Executive Orders are believed to conflict with the principles of this Charter.

Section IV — Surgeon General

The Surgeon General shall oversee matters concerning public health, medical practice, and the establishment of health regulations throughout Shamrock State.


Article III — The Legislative Branch

The legislative authority of Shamrock State shall be vested in the Assembly of County Representatives.

Each recognized county shall elect one Representative to serve as the voice of their citizens.

Initially, the Assembly shall consist of:

  • The Representative of Lemoyne County.
  • The Representative of New Hanover County.
  • The Representative of West Elizabeth County.

Additional representatives may be established by law as the population of Shamrock State expands.

Legislative Process

Any Representative may introduce a bill before the Assembly.

A proposed bill shall become approved legislation upon receiving a 66% majority vote of the Assembly.

Following approval, the bill shall be presented to the Governor, who may:

  • Sign the bill into law.
  • Return the bill to the Assembly with a veto.

The Assembly may overturn a gubernatorial veto by a unanimous vote of all sitting Representatives.


Article IV — The Judicial Branch

The judicial authority of Shamrock State shall be vested in the office of the Chief Justice and the Marshal Service.

Section I — Chief Justice

The Chief Justice shall serve as the highest judicial authority within Shamrock State.

The Chief Justice shall have the authority to:

  • Preside over significant legal proceedings.
  • Interpret the application of the State and Federal Constitution when applied to an enacted or proposed law.
  • Review legislation and Executive Orders.
  • Declare laws or Executive Orders invalid when they conflict with this Charter or the fundamental principles set forth in the State Constitution.
  • Affirm the appointment of duly elected or selected Judge(s) to their Courts of Authority

Any law or order struck down by the Court may be revised and presented again through the proper legislative process.

Section II — Marshal Service

The Marshal Service shall serve as the impartial law enforcement authority of the State of Shamrock and shall exercise such Federal and State law enforcement powers as are vested in it by the Government of the United States of America and the Government of Shamrock State.

The Marshal Service shall not be subject to the direct command of the Governor or any officer of the Executive Branch. It shall remain under the judicial oversight of the Courts of Shamrock to ensure the impartial execution and enforcement of the law.

The Attorney General may, within the lawful execution of their office, call upon the Marshal Service to conduct investigations, execute lawful warrants, assist in the prosecution of offenses, and undertake such other lawful enforcement actions as are necessary. Such authority shall not be construed as granting the Attorney General command over the officers, administration, or internal governance of the Marshal Service.

Upon the written authorization of the Governor, the Attorney General may declare any person or organization whose actions constitute an extraordinary and ongoing threat to the peace, security, or lawful order of Shamrock State to be a Public Enemy of the State. Upon such declaration, the Attorney General may direct the Marshal Service to devote additional resources, establish lawful bounties, and coordinate enhanced efforts toward the investigation, pursuit, and apprehension of the declared Public Enemy.

A declaration of Public Enemy shall not remove the constitutional protections afforded to any person, nor authorize the Marshal Service or any officer of the Government to act beyond the authority granted under Federal law, State law, or the Constitutions of the United States of America and the State of Shamrock.

The Marshal Service shall be responsible for investigating violations of Federal and State law within its jurisdiction, executing lawful warrants and orders of the Courts, maintaining public order, and providing for the security and protection of the institutions, officers, and lawful proceedings of the Executive, Legislative, and Judicial Branches of the Government of Shamrock State.

The protective responsibilities of the Marshal Service shall include the safeguarding of State officials, government buildings, legislative assemblies, judicial proceedings, elections, and other official functions of government where the preservation of public safety, constitutional order, and the continuity of government require the presence of the Service.

No officer of the Government of Shamrock shall compel the Marshal Service to act contrary to the Constitutions of the United States of America or the State of Shamrock, the lawful orders of the Courts, or the laws of the jurisdiction.


Article V — Executive Orders and Judicial Review

The Governor may issue Executive Orders that take effect immediately upon declaration.

Executive Orders may be challenged before the Court by the Assembly, the Attorney General, or any citizen with standing.

The Chief Justice may invalidate any Executive Order found to exceed the lawful authority of the Governor.

The Assembly may also overturn an Executive Order by a unanimous vote.


Article VI — Removal of Public Officials

To preserve the integrity of the State and prevent the abuse of public authority, all elected and appointed officials shall remain accountable to the citizens and the government.

The Assembly of Representatives may bring Articles of Impeachment against any State official, including the Governor, for misconduct, abuse of authority, neglect of duty, or corruption.

Impeachment shall require a majority vote of the Assembly.

Following impeachment, the Chief Justice shall conduct a public hearing and trial regarding the accusations.

Removal from office shall require a unanimous vote of the Assembly following the conclusion of the hearing.


Article VII — Transitional Government

Upon ratification of this Charter, the former Governors of Lemoyne, New Hanover, and West Elizabeth shall transition into the offices of their respective County Representatives.

These Representatives shall retain all rights to seek election to the office of Governor or any other office during future elections.


Article VIII — The Future of Shamrock State

This Charter shall stand as the foundation of a united government built upon representation, justice, and cooperation.

As Shamrock State grows and its population expands, its government may likewise evolve through lawful amendment and legislation, provided that the principles of balanced authority, fair representation, and equal justice remain preserved for all citizens.

By this declaration, the separate governments of old are dissolved and the State of Shamrock is hereby established.
