Constitution of the State of Shamrock
Preamble
We, the free citizens and duly established officials of the State of Shamrock, in order to secure justice, maintain civil order, promote the general welfare, and preserve the liberties entrusted to us under the Constitution of the United States of America, do hereby establish this Constitution as the highest law of the State of Shamrock.
United by our common frontier, our towns, our settlements, and our lands untamed, we declare that government derives its authority from the consent of the governed and shall remain forever answerable to the people.
Let this Constitution stand as the covenant between the citizen and the State: granting authority where necessary, limiting authority where dangerous, and ensuring that no office, however powerful, shall stand beyond the reach of law.
So ratified and entered into force by the People of Shamrock.
ARTICLE I — THE TERRITORY AND COUNTIES OF SHAMROCK
Section 1. The lands governed under this Constitution shall collectively be known as the State of Shamrock.
Section 2. The counties of Shamrock shall consist of Lemoyne County, New Hanover County, and West Elizabeth County.
Section 3. Additional territories may be organized into counties by an Act of the Assembly when population and settlement require representation.
ARTICLE II — THE SEPARATION OF GOVERNMENTAL POWERS
Section 1. The powers of the Government of Shamrock shall be divided into three separate and independent branches: Executive, Legislative, and Judicial.
Section 2. No person or office belonging to one branch shall exercise the powers belonging to another except where expressly permitted by this Constitution.
Section 3. Each branch shall possess the lawful authority to restrain abuses of power by the others through the systems of veto, judicial review, impeachment, and legislative oversight.
ARTICLE III — THE EXECUTIVE BRANCH
Section 1. The executive authority of Shamrock shall be vested in the office of the Governor.
Section 2. The Governor shall:
- Enforce the laws of Shamrock.
- Issue Executive Orders concerning the administration of the State.
- Approve or veto legislation passed by the Assembly.
- Appoint officers and officials as permitted by law.
- Represent the interests of the State and its citizens.
Section 3. The office of Deputy Governor may be established to assist the Governor and shall assume the duties of Governor during absence, incapacity, or vacancy.
Section 4. The Attorney General shall serve as the chief legal officer of the State and shall prosecute violations of State law.
Section 5. The Surgeon General shall oversee matters relating to public health, medical regulation, and the licensing of medical practitioners.
ARTICLE IV — THE LEGISLATIVE BRANCH
Section 1. The legislative authority of Shamrock shall be vested in the Assembly of County Representatives.
Section 2. Each recognized county shall elect one Representative to the Assembly.
Section 3. Any Representative may introduce legislation.
Section 4. A bill shall pass upon receiving a majority vote of the Assembly.
Section 5. Upon passage, a bill shall be presented to the Governor, who may sign it into law or return it to the Assembly with a veto.
Section 6. The Assembly may overturn a gubernatorial veto by a unanimous vote of all sitting Representatives.
Section 7. The Assembly shall have the power to establish additional rules governing its proceedings, provided such rules do not conflict with this Constitution.
ARTICLE V — THE JUDICIAL BRANCH
Section 1. The judicial authority of Shamrock shall be vested in the office of the Chief Justice and the Courts established under the laws of the State.
Section 2. The Chief Justice shall:
- Preside over trials and legal proceedings.
- Interpret the laws of Shamrock.
- Review laws and Executive Orders for compliance with this Constitution and the Constitution of the United States.
- Declare unconstitutional any law or governmental action that violates those documents.
Section 3. The Chief Justice may establish subordinate judges or magistrates as authorized by law.
ARTICLE VI — THE MARSHAL SERVICE
Section 1. The Marshal Service shall serve as the principal law enforcement authority of the State of Shamrock.
Section 2. To preserve the impartial administration of justice, the Marshal Service shall operate under the authority and supervision of the Judicial Branch and shall not be subject to direct command by the Governor or any officer of the Executive Branch.
Section 3. The duties of the Marshal Service shall include:
- Executing lawful warrants and orders of the Courts.
- Investigating violations of State law.
- Maintaining public order and safety.
- Providing protection to the Courts and officers of justice.
Section 4. No officer of the State shall command the Marshal Service to perform any act contrary to the Constitution or laws of Shamrock.
ARTICLE VII — ELECTIONS AND PUBLIC OFFICE
Section 1. All lawful citizens of Shamrock possessing the qualifications established by the Constitution of the United States and laws of this State shall have the right to participate in public elections.
Section 2. The Governor and County Representatives shall be elected by a free and fair vote of the people.
Section 3. The candidate receiving the greatest number of lawful votes shall be declared elected.
Section 4. In the event of a disputed election, the Chief Justice shall conduct a review and issue a binding determination.
Section 5. The Legislature may establish additional regulations concerning terms of office, qualifications of candidates, and election procedures.
ARTICLE VIII — IMPEACHMENT AND REMOVAL FROM OFFICE
Section 1. All elected and appointed officers of Shamrock remain accountable to the people and subject to removal for misconduct, corruption, abuse of authority, neglect of duty, or violation of the Constitution.
Section 2. Articles of Impeachment may be introduced by any County Representative and shall be approved by a majority vote of the Assembly.
Section 3. Upon impeachment, the Chief Justice shall convene a public hearing and examine the evidence and testimony presented.
Section 4. Removal from office shall require a unanimous vote of the Assembly following the conclusion of the hearing.
ARTICLE IX — AMENDMENTS TO THIS CONSTITUTION
Section 1. This Constitution may be amended by a unanimous vote of the Assembly and the approval of the Governor.
Section 2. No amendment may violate the rights guaranteed to the citizens of Shamrock under the Constitution of the United States of America.
ARTICLE X — TRANSITIONAL GOVERNMENT
Section 1. Upon ratification of this Constitution, the former Governors of the lands now incorporated into Shamrock State shall become the first County Representatives of their respective counties.
Section 2. Such Representatives shall retain the right to seek election to the office of Governor or any other office for which they are qualified.
Section 3. Existing laws, ordinances, and lawful governmental actions of the former states shall remain in effect until repealed, amended, or replaced by the Government of Shamrock.
